Face Covering Update Following Conflicting Legal Requirements

After receiving word of Hays County Judge Becerra's Executive Order issued late Friday requiring the wearing of face coverings in schools, Wimberley ISD sought legal guidance due to the conflicting nature of the county judge's order compared to the Texas Governor's own Executive Order.
WISD's legal counsel shared the following: "The law is quite clear that under a Disaster Declaration 'the governor is the commander in chief of state agencies, boards, and commissions having emergency responsibilities.' (Tex. Gov’t Code 418.015(c)) For that reason WISD will continue to follow the Governor's Executive Order in forming our own health and safety protocols. There are also two cases pending at the Texas Supreme Court involving the Governor's Executive Order that may provide additional clarity when/if they are resolved this coming week.
